3. Data we process

In connection with your application for employment with us, we may collect and process the following categories of personal data:

— Personal identifying data (such as names, nationality, date and place of birth);

— Contact details (such as email, postal address, telephone number);

— Information about your education, skills and professional experience (such as name of educational institution, period of study, year of graduation and educational qualification degree and certificates, professional qualification related to work, participation in trainings, seminars and courses, proficiency data in a foreign language, professional experience, including references provided by you from current and previous employers or colleagues;

— Information collected during the interviews (such as notes taken by the interviewer, test results, solutions to case studies and tasks,  carried out as part of the selection process) ;

 — Information related to your current remuneration, including social benefits;

— Other information or data contained in your application that you have indicated in your CV, cover letter and/or shared during interviews (such as a photograph of yourself, work preferences, current remuneration, expected remuneration, membership in professional organizations).

In the event that you are approved, we may require you to provide us with additional information depending on the requirements for the position you have applied for and the requirements of applicable law for the purposes of concluding an employment contract.

At the initial stage of the selection process,   we do not aim to obtain special categories of personal data from you. Special categories of personal data are data revealing racial or ethnic origin, political views, religious or philosophical beliefs or trade union membership, as well as the processing of genetic data, biometric data for the sole purpose of identifying an individual, health data or data about the sex life or sexual orientation of the natural person.

It is possible that at a later stage of the recruitment process we may need special categories of personal data about you, in the event that a specific legal act obliges us to do so.

In the event that you provide us with information constituting a special category of personal data, you agree that we may use it in accordance with applicable law and this Privacy Notice.

4. How do we collect personal data for recruitment purposes?

  • Directly:We may receive personal data directly from you when you submit your CV and accompanying documents (such as diplomas, certificates, cover letters, references from employers and colleagues).
  • Indirectly:We may receive your personal data through the following sources of information: Professional social networks – We may review professional social networks (such as LinkedIn ) in which you have created your user profile to obtain information relating to to you, which will be relevant for the purposes of recruitment and selection of personnel. This information may include your name and job title, as well as education and work experience details and, depending on your privacy settings, additional information relating to you that is publicly available in your profile. 
  • Recruitment agency – We may receive your personal data from a recruitment agency in case we engage one for the purposes of a specific campaign.
  • Benefit Systems employees who refer you as potential job candidates
  • In the event that you have consented to us retaining your personal data for future vacancies or other employment opportunities, we may review our database of job candidates to conduct research for a suitable candidate in connection with a specific campaign on personnel selection,

5. For what purpose do we process your personal data?

Benefit Systems may use your personal data for any or all of the following purposes:

— Carrying out a preliminary selection of job candidates whose education and professional experience meet the requirements for the position they are applying for;

— Making contact with you to obtain additional information or to schedule an interview;

— Organizing and conducting an interview for the purpose of assessing whether you are a suitable candidate for the position and whether your skills, motivation, education and experience meet the requirements for the specific position, as well as preparing the relevant internal documents during the   recruitment campaign ;

— Sending an offer, in case you are evaluated as a suitable job candidate;

— Storing your personal data for future vacancies or other employment opportunities, in case you have provided consent for this;

— Fulfillment of regulatory obligations.

6. On what legal grounds do we process  your personal data?

We rely on the following legal grounds for processing personal data when we process your personal data for recruitment and selection purposes:

  • Legitimate interest– We rely on legitimate interest based on our assessment that the processing is transparent, reasonable and balanced in the following cases:
  • Conducting recruitment - We rely on legitimate interest as a legal basis for processing your personal data when we conduct a recruitment campaign and you apply for a specific position. In these cases, our legitimate interest relates to our intention to find suitable new employees to join our team, as well as to secure employment for you in the event that you meet the requirements for the position.
  • Protection of our legal rights and interests in case of legal and administrative proceedingsWe rely on legitimate interest as a legal basis for processing your personal data in the event of claims or reports filed against us. 
  • Consent– ​​We rely on your consent in the following cases:
  • Sending your CV to our email address – We rely on your consent to process personal data relating to you when you send your CV to our email address and would like to join our team without applying for a specific open position.
  • Retention of your personal data for future vacancies or other employment opportunities – We rely on your consent to process your personal data when your application for a specific open position is not successful, but you would like to retain your data for future vacancies jobs and other employment opportunities.

7. Why is it necessary to provide us with your personal data?

    The provision of personal data is voluntary but necessary for the purposes of the recruitment process. If you do not provide us with sufficient information, we may be unable to consider your application.

    8. Do we share personal data with third parties?

    We may share personal data with trusted third parties who assist us in carrying out our business activities. These third parties are legally bound to adequately protect the data we entrust to them. We may engage some or all of the following categories of third parties:

    • Persons who are involved in the administration of our business or support our infrastructure or services (such as providers of telecommunications services, postal or transport services, storage and archiving services, IT support services);
    • Our professional consultants;
    • State bodies, in accordance with the provisions of the applicable law;

    9. Do we transfer your personal data outside the European Economic Area?

      We store personal data on servers located in the European Economic Area (EEA).

      10. How long do we store your personal data?

      All documents that you have submitted and that we have received from you in the course of the relevant recruitment campaign containing your personal data, including but not limited to CVs, certificates, test results and others, will be stored for a period of 6 (six) months, counted from the end of the campaign, if your application is unsuccessful and you have not provided consent for us to keep your data for future vacancies and other job opportunities. In the event that you provide us with original documents in the course of the campaign, they will be returned to you within the period specified in the previous sentence.

      Benefit Systems' internal documents compiled in the course of the given recruitment campaign, which may contain your personal data, will be stored for a period of 3 (three) years from the end of the campaign for the purposes of establishing, exercising or defending legal claims and resolving disputes in connection with proceedings under the Anti-Discrimination Act.

      Benefit Systems will store and use your documents containing personal data that you submitted when applying for a job in the course of subsequent recruitment campaigns, for a period of 6 (six) months from their submission, in the event that you have given express consent to this.

      11. What are your rights under data protection legislation and how can you exercise them?

      Your rights in relation to the protection of personal data are set out below.

      • Access– You may ask us to confirm whether we are processing personal data relating to you and, if we are processing your personal data, to provide you with detailed information.
      • Correction- You may ask us to correct our records containing personal data if you believe they contain incorrect or incomplete information about you.
      • Deletion– You may request that we delete your personal data after you withdraw your consent to the processing of personal data or when we no longer need it for the purposes for which the data was originally collected.
      • Restriction of processing– You may ask us to temporarily restrict the processing of your personal data if you dispute its accuracy, prefer to restrict the processing of the data instead of asking us to delete it, or wish to keep it for you for the purposes of establishing, exercising or defending legal claims. It is possible that the processing of your personal data will be temporarily restricted until we determine whether we have legitimate grounds for processing that prevail. You may require us to notify you prior to revoking the temporary restriction of processing.
      • Data Portability– In some cases where you have provided us with your personal data, you may request that we transfer that personal data (in a structured, widely used and machine-readable format) directly to another company where this is technically feasible.
      • Object to processing– You can object to the use of your personal data if we no longer have the right to use it. In these cases, we will not continue to process your personal data unless we demonstrate the existence of compelling legal grounds for the processing that take precedence over the interests, rights and freedoms of the data subject, or for the establishment, exercise or defense of legal claims.

      Right to withdraw consent - You can withdraw your consent for one or more specific purposes related to the processing of your personal data. This will not affect the lawfulness of the processing of your data prior to the withdrawal of consent.
